Your choice to purchase your family’s food from local sources is one of the main principles for a healthy economy, healthy community and a healthier you. Your donation directly supports the Funds work to protect your right to obtain the foods of your choice from the source of your choice.
PUBLIC INTEREST LITIGATION (PIL)
Public Interest Litigation (PIL) typically involves more than just a case of defending a particular person in court. Qualifying cases taken on by the Fund usually impact more than a single farmer or business entity; the outcome potentially impacts consumers and affiliate communities as well as farmers and artisan food producers.
Funding for PIL cases can be provided through grants from 501(c)(3) nonprofits because of the potential broad spectrum implications involved in such cases. Favorable court rulings and administrative decrees can form the basis for social change as well as resolving multiple claims through a single lawsuit. This is the public benefit of such legal challenges, sometimes even forcing a favorable change in existing laws whether they be struck down as unconstitutional or targeted by legislatures for elimination or revision.
The Farm-to-Consumer Legal Defense Fund is a 501(c)(4) nonprofit and as such it is able to freely engaging in lobbying to influence lawmaking directly and advocate for change. However, donations to the Fund are not tax-deductible.
Donations to the Farm-to-Consumer Foundation [EIN 26-0758408] are tax deductible and can be earmarked for public interest litigation (PIL) to be directed as part of a future grant to the Farm-to-Consumer Legal Defense Fund for qualifying cases.

The Farm-to-Consumer Foundation supports public interest litigation (PIL) through grants to the Farm-to-Consumer Legal Defense Fund to represent producers and consumers who have had government enforcement actions directed at them, as well as challenge Federal, state and local laws that prohibit or restrict access to local food.
The Farm-to-Consumer Foundation (FTCF) is a 501(c)(3) Nonprofit Educational Charitable Organization [EIN 26-0758408] created to expand public awareness about sustainably farmed food, and increase choices and access to local sources for the health of the community through nutrient-dense food, economic growth and opportunity for conversation that knits communities together for positive change.
FTCF supports small family farms growing and raising these foods with continuing education on best practices related to soil, forage, food and animal health, advocacy for the direct consumer-farmer relationship, and support Public Interest Litigation to protect opportunities to buy from those you trust.
As a sister organization of the Farm-to-Consumer Legal Defense Fund, the Foundation assists public interest litigation through grants for qualifying cases, particularly those involving producers and/or consumers who have had government enforcement actions directed at them, as well as cases challenging federal, state and local laws that prohibit or restrict access to local food.
Many people choose to donate directly to the Farm-to-Consumer Legal Defense Fund and forgo the tax deduction. Here are some reasons why:
Contributions made directly to the Fund are immediately available to
- cover operational expenses
- go toward litigation that does not qualify as PIL
- support member services besides court representation
- help the Fund take on more cases for individual farmers and consumers
- assist efforts to make changes in the law at the state and local level
Lastly, though not least, only donations to the Fund qualify for the fabulous donor gifts offered during the Annual Appeal.
